This document sets out the terms and conditions under which each Member participates
in the Regent Rewards program ("Program"). 1. Membership
1.1 Membership is by invitation from Regent Personnel Pty Ltd T/A Regent
Recruitment (''Regent Recruitment'') Only temps and/or contractors and/or
employees of Regent Recruitment are eligible to become a member of the Program
("Member"). Upon acceptance of an invitation to become a Member,
Regent Recruitment will enrol the Member in the Program and will issue an individual
Program account ("Account") and Program password ("Password")
to the Member. Each Member must ensure the confidentiality of the Member's Account
and Password. 1.2 Regent Recruitment may suspend or terminate a Member's
participation in the Program at any time in its absolute discretion and without
liability. 1.3 Without limiting the preceding paragraph, if a Member
breaches any of the terms or conditions or supplies any misleading information
or makes any misrepresentations to Regent Recruitment or a supplier, then Regent
Recruitment may, at its sole discretion and without any liability, do one or more
of the following: (a) suspend or terminate the Member's participation in the
Program; (b) reverse or cancel the Member's points or any part thereof; or
(c) cancel or procure that suppliers refuse to honour any Rewards, Discounts or
both, that have been claimed by or provided to the Member. 1.4 Regent
Recruitment may cancel all or any points that have accrued where a Member's right
to participate in the Program is suspended or terminated. 1.5 All Members
that cease employment through Regent Recruitment will remain members in the Reward
Club program for a period of 12 months after their last day of work recorded on
the Regent payroll. After that 12 month period has lapsed, if no further employment
with Regent is undertaken, those Members will be cancelled from the program and
any remaining accumulated points will be immediately forfeited. 2.
Points 2.1 Points will accrue to each Member's Account for each hour
worked after commencement of their assignment with Regent, plus bonus points can
be earned from the completion of a number of actions described on the Regent Recruitment
website (such as job or candidate referrals) - all of which will attract points.
2.2 Regent may also in its absolute discretion,
award additional Discretionary Points from time to time as it sees fit. 2.3
Regent Recruitment may apply minimum points redemption in some categories of Rewards
as stated on the Rewards website. 2.4 Regent Recruitment
may in its absolute discretion, without prior notice to you, retrospectively increase
or decrease minimum points required for the redemption of Rewards from time to
time, or change the program points structure, resulting in a change to the points
balance of an Account. 2.5 Points are not transferable
between Members or Accounts. 2.6 Each Member is responsible
for ensuring that points are properly credited to his or her Account. If a Member
believes that points have not been correctly allocated to the Member's Account,
the Member must notify Regent Recruitment within 28 days of the issue of the points
appearing on the Member's Account. Regent Recruitment will be the final arbiter
in any points dispute. 2.7 There is a set point limit per
member ("Point limit"), currently set at 8,000 points (raised
from 5,000 points in January 2009). Regent Recruitment reserves the right to vary
the point limit from time to time as it sees fit. Regent Recruitment also reserves
the right to issue bonus points to a value greater than the point limit, however
once a member has earned up to or over the point limit, no additional points will
be added to the Member's account until that Member has redeemed Rewards to bring
the account balance under the point limit. 3. Claiming
Rewards 3.1 The program applies only to the Rewards displayed on
the Rewards website ("Rewards"). Regent Recruitment may vary
those Rewards from time to time at its absolute discretion. 3.2
The terms and conditions applicable to a Reward claim will be those in force at
the time the Reward is claimed. 3.3 The procedure for claiming
the Rewards displayed on the Rewards website is set out on that website. Regent
Recruitment may change the claim procedures at any time. 3.4 All Rewards
are subject to availability. Regent Recruitment is not liable for any Reward not
being available for any reason whatsoever. Where an item displayed is not available,
Regent Recruitment reserves the right to substitute a Reward which Regent Recruitment,
in its absolute discretion, considers equivalent. 3.5 No claims for Rewards
are confirmed until processed and points balances verified by Regent Recruitment.
3.6 The Member must claim rewards personally. 3.7 Rewards cannot
be claimed jointly or by pooling points with another Member or other Members.
3.8 A request or claim for a Reward cannot be altered or revoked by a Member
once made. 3.9 Upon redeeming a Reward, the Member releases Regent Recruitment
from any liability in respect of the redemption or use of the Reward.
3.10 Redemption of all Rewards by Members is subject to the terms and conditions
of each Reward supplier. All Members must read and agree to the supplier's terms
and conditions (displayed on the Rewards website)] at the point of redemption
of each Reward. 4. Claiming Bonus Points for Referrals
Job referrals 4.1 Any permanent placement with a
referred client must exceed the 3-month probationary period before payment of
bonus points is made. 4.2 Any temporary placement with
a referred client must result in a minimum duration of 4 weeks before bonus points
may be paid. 4.3 The referred client must consent to their
details being passed on to Regent Recruitment. Candidate
referrals 4.4 The referred person cannot be already
part of the Regent Recruitment database. If this occurs, payment of bonus points
will be refused. 4.5 Candidates can only be referred once.
4.6 The referred person must consent to their details
being passed on to Regent Recruitment. 4.7 Regent must
place the referred person into a role for a minimum duration of 4 weeks for a
temporary role before bonus points may be paid. 4.8 Placement
of the referred person into a permanent role must exceed the 3-month probationary
period before bonus points may be paid. General 4.9
The referring Member is required to monitor the referral and to contact Regent
Recruitment to claim their reward bonus points upon fulfilment of referral requirements
according to these terms and conditions. 4.10 The referral
is valid for a period of six months from the date Regent Recruitment receives
details of the referred job or referred candidate. 5.
Delivery of Rewards 5.1 Processing and delivery of Rewards may take
up to 10 weeks. Regent Recruitment is unable to warrant delivery times or dates
for Rewards. 5.2 If a Reward arrives damaged, a Member
must notify the specified supplier of that specific reward within 5 days of receipt
providing full details of the defect including the name of the carrier. 6.
Cancellation of Program 6.1 The Program applies only to the Rewards
displayed on the Rewards website. Regent Recruitment may vary those Rewards and
their point values from time to time at its absolute discretion. 6.2
Regent Recruitment may cancel the Program at any time by written notice to Members
("Cancellation Notice"). 6.3 If the Program is
cancelled, a Member has 3 months from the date of the Cancellation Notice to redeem
points for Rewards after which time the points are forfeited and cannot be redeemed. 7
Discounts 7.1 All program Discounts, as listed on the 'Discounts'
page of the rewards website, are provided by third party suppliers and Regent
Recruitment disclaims any liability resulting from the redemption of any program
discount by members. 7.2 All details of Discounts displayed
on the Rewards website are based on information provided by third party suppliers
and Regent Recruitment expressly disclaims any responsibility and liability for
any inaccuracy contained in it. 7.3 Except as provided
in any law which cannot lawfully be excluded or modified by agreement, Regent
Recruitment gives no warranty, express or implied, with respect to any Discount,
including the merchantability or quality of Discounts or their suitability for
any purpose. If a Member has any complaints or queries in relation to a Discount,
the Member should contact the supplier of the Discount. 8
Disclaimer 8.1 Regent Recruitment is not liable for taxation that
is imposed on a Member in relation to Rewards. 8.2 Except
as provided by any law which cannot lawfully be excluded or modified by agreement,
the Member acknowledges that Regent Recruitment is not liable, including for negligent
acts and omissions, in relation to: (a) any breach of these terms and conditions
by Members; (b) the Rewards supplied, (c) death, injury or consequential
loss or damage arising from the supply or use of a Reward; (d) any failure,
delay or inability to provide a Reward to a Member; or (e) information provided
by third parties, including Reward suppliers (f) any delay in the supply or
non-availability of a Reward. 8.3 All details of Rewards
displayed on the Rewards website are based on information provided by third party
suppliers and Regent Recruitment expressly disclaims any responsibility and liability
for any inaccuracy contained in it. 8.4 Except as provided
by any law which cannot lawfully be excluded or modified by agreement, Regent
Recruitment gives no warranty, express or implied, with respect to any Reward,
including the merchantability or quality of Rewards or their suitability for any
purpose. If a Member has any complaints or queries in relation to a Reward, the
Member should contact the supplier of the Reward. 8.5 Any
liability Regent Recruitment has which cannot be excluded due to the operation
of law is limited, where permitted by law, to supplying the point(s) or Reward(s)
again or paying the cost of supplying the Reward, at Regent Recruitment's option. 8.6
Suppliers do not have any authority, express or implied, to make any representation,
warranty or statement on behalf of Regent Recruitment and Regent Recruitment accepts
no liability in respect of such representations, warranties or statements. 9
General 9.1 Participation in the Program by a Member
is deemed to be acceptance of all terms and conditions in this document and on
the Regent Recruitment Rewards website. Regent Recruitment reserves the right
to vary these terms and conditions from time to time at its sole discretion. 9.2
All Rewards displayed on the Regent Recruitment website are subject to availability.
9.3 Regent Recruitment co-ordinates the Program. All enquiries
and/or matters of dispute which cannot be resolved with a supplier should initially
be directed to Regent Recruitment's 'Rewards Program Co-ordinator' by telephoning
03 8646 9150. 9.4 In the case of any dispute and/or any
matters pertaining to the Program, the decision of Regent Recruitment is final.
9.5 Points are not property, have no cash or monetary
value and are not redeemable for cash. 9.6 These terms
and conditions are effective as at the date of publication and may be amended
from time to time. Members should refer to the Reward Club website for the current
terms and conditions. 9.7 This promotion is run by Regent
Personnel Pty Ltd T/A Regent Recruitment and all parties and the law in force
in the state of Victoria governs the transactions contemplated by this promotion. 10
Privacy Act 10.1 The collection of any private information
of a Member ("Private Information") will be used by Regent Recruitment
solely for the purpose of the Program. 10.2 Private Information
will not be disclosed by Regent Recruitment to any person other than as reasonably
required for the purposes of the Program, or as required by law. 10.3
A Member may view his or her Private Information at any time by accessing the
Rewards website using his or her Account and Password details. 10.4
Regent Recruitment may send special offers to Members from time to time using
Private Information. However, if a Member does not wish to receive offers, the
Member may contact Regent to remove that Member's name from any reward program
mailing list. 10.5 Regent Recruitment may place a
photograph of any Member with other personal information about the Member (including
name, the number of points accrued and the reward chosen) on its website for the
purpose of marketing the Program. |
